§ 90-8. Penalties for offenses.

A.Any person committing an offense against any provision of this code shall be guilty of a violation punishable as follows: by imprisonment for a term not exceeding 15 days or by a fine not exceeding $250, or by both such a fine and imprisonment. The continuation of an offense against the provisions of this code shall constitute, for each day the offense is continued, a separate and distinct offense hereunder.B.Notwithstanding any other provision of this chapter, any person committing an offense in violation of § 90-5I shall be guilty of a violation punishable as follows:(1)For the first conviction, a fine of $500/$1,000.(2)For a second or subsequent conviction, a fine of $1,000/$2,000, imprisonment for a term not exceeding 15 days, or both such a fine and imprisonment.(3)Community service.(4)Each day such violation shall continue shall constitute a separate violation.C.In addition to the above-provided penalties, the Town Board of the Town of Greenport may also maintain an action or proceeding in the name of the Town in a court of competent jurisdiction to compel compliance with or restrain by injunction the violation of this chapter and/or to obtain restitution for the Town for costs incurred by the Town in identifying and remedying each violation, including but not limited to reasonable attorneys' fees.
